APPLICATION OF PENAL LAW IN ECUADOR: A COMPREHENSIVE ANALYSIS

The legal penal system of a country is essential to maintain social order and guarantee citizen safety. In Ecuador, Penal Law plays a crucial role in regulating and prosecuting criminal behavior, as well as protecting individual and collective rights. This article provides an in-depth analysis of the penal legal framework in Ecuador, from its historical evolution to its practical application today. It addresses topics such as the classification of crimes, the penal process, security measures, the execution of sentences, and the current challenges facing the Ecuadorian penal system. From the enactment of the Penal Code in 1837 to the most recent reforms, Ecuador has sought to improve the administration of justice and the protection of human rights. Despite advances, the penal system faces challenges such as prison overcrowding and the need to ensure the impartiality and efficiency of the judicial system. Currently, Ecuador is striving to balance the protection of human rights with the need to maintain public order and security, adopting a more comprehensive and humanitarian approach.
